These Terms and Conditions set out the rights, obligations, and responsibilities of all parties.

  • “Client”, “You”, “Your” refers to the customer storing goods

  • “PalletSafe”, “We”, “Us” refers to PalletSafe Ltd

These Terms apply to all storage and related services provided by PalletSafe Ltd unless otherwise agreed in writing.

Important:
Our liability for loss or damage to goods is limited as described in these Terms.

1. Services Provided

1.1 PalletSafe provides indoor palletised storage services at its Croydon facility.

1.2 Additional services (including handling, palletising, wrapping, and distribution) may be provided where agreed in writing.

1.3 All goods are handled exclusively by PalletSafe staff.

1.4 Clients shall not have direct access to the warehouse.

2. Definitions

2.1 A “Pallet” is defined as all goods stacked on a single pallet and handled as one unit.

2.2 A “Week” is defined as a 7-day period commencing from the date goods are received into storage.

3. Charges and Payment

3.1 All services are charged in accordance with the PalletSafe Price Sheet in force at the time.

3.2 New clients are required to pay via proforma invoice prior to storage.

3.3 Ongoing services are invoiced weekly in advance unless otherwise agreed.

3.4 Payment terms are strictly due on receipt.

3.5 PalletSafe reserves the right to:

  • Suspend services

  • Withhold goods

  • Refer unpaid invoices to collection agencies

3.6 Interest may be charged on overdue amounts at 4% above Bank of England base rate.

4. Client Responsibilities

4.1 The Client warrants that:

  • All goods are safe, stable, and suitable for pallet storage

  • Goods are properly packed, secured, and labelled

4.2 The Client must provide:

  • Accurate description of goods

  • Estimated value (if applicable)

4.3 The Client is responsible for arranging adequate insurance cover for their goods.

4.4 The Client must provide up-to-date contact details at all times.

5. Prohibited Goods

5.1 The following goods are strictly prohibited unless agreed in writing:

  • Hazardous or dangerous materials

  • Flammable or explosive items

  • Chemicals or toxic substances

  • Lithium-ion batteries (unless declared and approved)

  • Food or perishable goods

  • Illegal or stolen goods

5.2 PalletSafe reserves the right to refuse or remove any goods deemed unsafe.

5.3 If prohibited goods are stored without disclosure, PalletSafe may:

  • Remove or dispose of them

  • Recover all associated costs from the Client

6. Ownership of Goods

6.1 The Client confirms that:

  • They own the goods or have full authority to store them

6.2 The Client agrees to indemnify PalletSafe against any claims arising from ownership disputes.

7. Liability and Insurance

7.1 PalletSafe shall exercise reasonable care in handling and storing goods.

7.2 All goods are stored at the Client’s risk.

7.3 PalletSafe’s liability for loss or damage is limited to:

  • £500 per pallet, or

  • The declared value (if agreed in writing prior to storage),
    whichever is lower.

7.4 PalletSafe shall not be liable for:

  • Loss of profits or business interruption

  • Indirect or consequential losses

  • Damage caused by inadequate packaging

  • Inherent defects in goods

7.5 The Client is strongly advised to insure goods.

8. Client Indemnity

8.1 The Client shall indemnify PalletSafe against any:

  • Loss

  • Damage

  • Injury

  • Costs or claims

arising from:

  • The nature or condition of the goods

  • Breach of these Terms

  • Acts or omissions of the Client

9. Warehouse Access and Handling

9.1 Clients are not permitted access to the warehouse.

9.2 All goods must be delivered to and collected from PalletSafe via agreed procedures.

9.3 PalletSafe retains full control over the handling and positioning of goods.

10. Claims

10.1 Any loss or damage must be reported in writing:

  • Within 7 days of collection or dispatch

10.2 Failure to notify within this timeframe may invalidate the claim.

11. Delays and Third Parties

11.1 PalletSafe shall not be liable for delays caused by:

  • Third-party couriers

  • Events outside reasonable control

11.2 Where third-party transport is used, their terms and liability limits apply.

12. Lien and Right to Withhold Goods

12.1 PalletSafe shall have a lien over all goods for unpaid charges.

12.2 Goods may be withheld until all outstanding amounts are paid.

12.3 Storage charges will continue to accrue during this period.

13. Sale or Disposal of Goods

13.1 If payment remains outstanding for 30 days, PalletSafe may:

  • Sell goods

  • Dispose of goods

13.2 Proceeds will be applied to outstanding balances and costs.

13.3 Any shortfall remains payable by the Client.

14. Termination

14.1 Either party may terminate the agreement with one week’s written notice.

14.2 All outstanding charges must be settled prior to release of goods.

15. Force Majeure

PalletSafe shall not be liable for failure or delay caused by events beyond its control, including:

  • Fire, flood, or extreme weather

  • Industrial disputes

  • Government action

16. Subcontracting

PalletSafe reserves the right to subcontract any part of its services.

17. Governing Law

These Terms shall be governed by English law, and disputes shall be subject to the jurisdiction of the courts of England and Wales.
